#MYOZ Think Australia Competition – Terms and Conditions

  1. Introduction

    1.1 The #MYOz Think Australia Competition (“Contest”) is organised by the Australian High Commission Malaysia (“Organiser”).

    1.2 These terms and conditions (“Terms and Conditions”) establish the parameters under which you (“Participant/s”) are entitled to participate in the Contest. 

    1.3By entering the Contest, Participants confirm they have read, understood and agree to abide by, these terms and conditions.
     
  2. Eligibility

    2.1 The Contest is open to all Malaysian citizens who are 18 years old or above at the time of entering the Contest.

    2.2 The Contest is not open to employees of the Organiser, their spouse, defacto partner or members of their immediate family (children, grandchildren, parents, grandparents, siblings or siblings-in-law).

    2.3 The Organiser may, at its sole discretion, disqualify any entries and prohibit further participation in the Contest by any Participant who acts in violation of these Terms and Conditions, or otherwise in a manner which is likely to bring the Contest or the Organiser into disrepute.
     
  3. Duration

    3.1 The Contest will begin on Thursday, 21 December 2017 (0800 GMT+8) and all entries must be received by Wednesday, 31 January 2018 (1600 GMT+8) (“Contest Period”).
     
  4. Mechanics

    4.1 To enter the Contest, Participants must submit:

    a) a photo of Participant with something that represents the Malaysia-Australia relationship;

    b) a caption to the photo (maximum 30 words) explaining what the relationship means to them and/or their favourite thing about Australia; and 

    c) their personal details for verification and contact purposes (name, date of birth, address, email address and phone number).

    4.2 Entries must be submitted by private message to the Organiser’s Facebook page (@AusinMalaysia).

    4.3 There is a limit to one (1) entry per person.
     
  5. Selecting the winners

    5.1 At the end of the Contest Period, the Organiser will shortlist 10 (ten) entries which it considers, in its sole discretion, to best capture the Australia-Malaysia relationship.

    5.2 The shortlisted entries will be published on the Organiser’s Facebook page on Wednesday, 7 February 2018, or such other date as advised by the Organiser.

    5.3 Members of the public will then be invited to ‘vote’ for their favourite Entry, by ‘liking’ that photo on Facebook. Voting will be open until Monday, 19 February 2018, or such other date as advised by the Organiser (“Voting Period”).

    5.4 At the end of the Voting Period, the Organiser will announce the results of the Contest on its Facebook page. The winning entry will be the entry which the Organiser considers, in its sole discretion, to best capture the Australia-Malaysia relationship. The runner up will be the entry which attracts the most ‘likes’.

    5.5 In the event that the winning entry is also the entry which attracts the most ‘likes’ on Facebook, the runner up prize will be awarded to the entry which attracts the second most number of ‘likes’ on Facebook.

    5.6 In the event the winner or runner up is disqualified, the Organiser will select an alternative winner and/or runner up in accordance with these Terms and Conditions

    5.7 Any decisions of the Organiser are final and no further correspondence will be entertained.
     
  6. Prizes

    6.1 The winning entry will receive two (2) premium economy return flights with AirAsia X Berhad (“Air Asia X”) to any of its Australian destinations.

    6.2 The runner up will receive two (2)  economy return flights with Air Asia X to any of its Australian destinations.

    6.3 The above Prizes will be valid from 26 January 2018 for a period of six (6) months and are exclusive of taxes, fees and any ancillary costs (such as seats, in-flight meals and baggage), which are to be solely borne by the Participant(s).

    6.4 The Prizes are subject to the terms and conditions imposed by Air Asia X and must be redeemed by the Participant(s) directly with Air Asia X. The Organiser will not be responsible, or intervene in, any dispute between the Participant and Air Asia X.
     
  7. Notification

    7.1 All communication and notifications regarding the Contest, including of shortlisted entries and winners, will be done via Facebook, or such other method as advised by the Organiser in its sole discretion.

    7.2 All correspondence will be deemed to be successful once recorded as sent or received by the Organiser on its Facebook page or computer records.

    7.3 In the event the Organiser cannot, despite reasonable efforts, contact the winner or runner up, the Organiser reserves the right to select another winner or runner up, in accordance with these Terms and Conditions.
     
  8. Privacy and Intellectual Property

    8.1 Participant’s entry in the Contest is subject to the Australian Department of Foreign Affairs and Trade’s Privacy Policy.

    8.2 Each Participant warrants that:

    a) the entry is their own, original work and they have full rights to use the relevant photos and captions and own the copyright therein;

    b) the entry does not infringe the rights, including intellectual property rights, of a third party;

    c) each individual who features in an entry has given consent for his/her image to be used in connection with the Contest and in accordane with these Terms and Conditions. Where an individual whose image is featured in an entry is aged less than 18 years, the Participant warrants that a parent or guardian of that individual has given the relevant consent.

    8.3 By entering the Contest, each Participant grants the Organiser a non-exclusive, irrevocable, royalty-free, worldwide, perpetual license (with a right to sublicense) to use, republish, edit and/or modify his/her entry, for purposes related to the contest or the work of the Organiser.

    8.4 In exercising the license referred to in clause 7.4, the Organiser will use reasonable efforts to maintain the integrity of the Entry, provide appropriate attribution and maintain the security of the Participant’s personal or contact details.
     
  9. Disclaimer, indemnity and limitation of liability

    9. 1 This Contest is in no way sponsored, endorsed, administered by, or associated with Facebook. Participants understand that they are providing information to the Organiser and not to Facebook.

    9.2 To the extent permitted by law, each Participant agrees to indemnify, release and hold harmless the Organiser from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from his/her participation in the Contest and the acceptance, use or misuse of any Prize that may be won.

    9.3 The Organiser is not responsible for any incorrect or inaccurate information in the offer or administration of the Competition, including but not limited to, errors in any publishing of these terms and conditions, selection or announcement of any winner, distribution of any Prize and software or network errors
     
  10. Rights of the Organiser

    10.1 The Organiser may, in its absolute discretion, modify, annul or rescind these Terms and Conditions at any time without prior notice and a Participants’ continued participation in the Contest amounts to acceptance of the revised Terms and Conditions.

    10.2 Failure by the Organiser to enforce these Terms and Conditions in any instance does not constitute any waiver by the Organiser of its rights, which shall be expressly reserved.

    10.3 If, for any reason, any aspect of the Contest is not capable of being run as planned, including because of computer virus, network failure, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Organiser which affect the administration, security, fairness, integrity or proper conduct of the Contest, the Organiser reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest.
